Terms and Conditions
- Per ISO 9001-2015 & AS9100D AS9100D – 2016; all below terms & conditions must be adhered to as part of doing business with Trojon Gear, Inc.
- All Controlled Documents (i.e., prints and associated technical data) will be destroyed after use.
- All records must be maintained and retrievable for 10 years from the creation date, then all records MUST be Shredded/destroyed.
- Prevention of Counterfeit Parts. Applies to all orders delivered to Trojon Gear, Inc.
- Foreign Object Damage (FOD) / Prevention, damage, and removal of all foreign objects. Applies to all orders delivered to Trojon Gear, Inc.
- Buyer shall not be bound by the Purchase Order until Seller executes and returns the acknowledgement copy of the Order to Buyer. Seller shall be bound by this Order and its terms and conditions when it executes and returns the acknowledgement or when it delivers to Buyer any of the items ordered or renders for Buyer any of the services ordered herein.
- The price set forth on the face hereof, if any, is the firm price and Buyer shall not be liable for any price increases of any nature. Seller warrants that the prices for the goods are not less favorable than those currently extended to any other customer for the same or like articles in such quantities, either generally or for any one sale to any other customer, from the date of acceptance of this order to the date the goods are invoiced by Buyer, Seller agrees to reduce the prices hereof correspondingly. Sellers total price shall include any Federal, State, or local sales, use or excise taxes levied upon or measured by the sale price or use of the goods. All such taxes, lawfully applicable, shall be listed separately on Seller’s invoice
- Promptness of delivery is of the essence of this order. Deliveries are to be made both in quantity and at a time that is specified on the reverse side hereof in schedule furnished hereunder (or otherwise) by Buyer. In the event of any late delivery, Buyer may, at its option, cancel this Purchase Order, partially cancel this Purchase Order, vary delivery terms hereunder, or purchase substitute items or services elsewhere. Any losses sustained or cost incurred by Buyer by reason of late delivery of items or rendering of services shall be paid to Buyer by Seller.
- Seller expressly warrants that all goods and/or work ordered according to plans, drawings, specifications or samples furnished by the Buyer and must provide a Certificate of Conformance.
- Seller shall bear the full risk of loss of any goods purchased pursuant hereto until goods are delivered to and received by Buyer. Seller specifically bears the risk of loss of any goods delivered to a common carrier whether Seller is responsible to pay for transportation or not.
- Seller agrees to not disclose to any person outside of his employ, and not authorized by Buyer to receive it, any information pertaining to Buyer’s affairs, and particularly its engineering or technical developments, and upon termination of this purchase order, will return to Buyer upon request all drawings, blueprints, descriptions, or other papers, which embody such confidential information. Seller warrants and agrees that such confidential information shall not be utilized in whole or in part by Seller or behalf of any other person, firm, or corporation without the prior written consent of Buyer.
- All materials or equipment purchased hereunder are subject to inspection and approval at Buyers destination. Buyer reserves the right to reject and refuse acceptance of items which are not in accordance with Buyer’s instructions, specifications, drawings and data or Seller’s warranty. Buyer may charge Seller for the cost of inspection merchandise rejected. Items not accepted will be held for Seller’s instruction at Sellers risk and if Seller so directs, will be returned at Sellers expense. No goods returned hereunder shall be replaced without a new Purchase Order. Payment for any article hereunder shall not be deemed an acceptance thereof.
- Customer has the right of access by the organization, their customer, and regulatory authorities to the applicable areas of facilities and to applicable documented information, at any level of the supply chain.
- Ensuring persons are aware of their contribution to product or service conformity
- Their contribution to product safety.
- The importance of ethical behavior.
- inspection and audit at the external provider’s premises.
- review of production part approval process data.
- inspection of products or verification of services upon receipt.
- review of delegations of product verification.
- If we have not had sales from your company in the previous (12) months all orders will be payable prior to shipment with either a credit card (+3.5% charge), or company check unless other arrangements are made. Larger orders may require an up-front deposit with placement of P.O.

- Price does not include freight and shipments are FOB our plant until otherwise agreed in writing.
- Generally, Trojon Gear guarantees only workmanship and materials supplied to Buyer to be defect free for 90 days.
- Trojon Gear does not accept design responsibility for any of the products or services we provide.
- Trojon Gear will perform all work written specifications, provided by the Buyer. The issuance of a Purchase Order by the Buyer signifies Buyer’s acceptance of design responsibility and any exceptions noted on the quotation.
- Work performed on Buyer supplied material is completed at Buyer’s risk and Trojon Gear will not be responsible in any way for spoilage or mis-machining of such material.
- Under no circumstances will the liability of Trojon Gear exceed the contract value of the items supplied.
Verification activities can include:
Review of objective evidence of the conformity of the processes, products, and services from the external provider (e.g., accompanying documentation, certificate of conformity, test documentation, statistical documentation, process control documentation, results of production process verification and assessment of changes to the production process thereafter).
